The consequences of a security breach hit companies in the pocketbook. Besides the cost of investigating a breach, a company experiencing a breach may face damage to its brands, loss of reputation, angry customers, lost business, and a hit to its stock value. Adding to its woes, government regulators may take action against the company, and private plaintiffs may file class action suits. Companies want to know what the law requires them to do to prevent security breaches, the legal consequences of a breach, and what they should do to respond to a breach. Stephen S. Wu is a partner in the Silicon Valley offices of Cooke Kobrick & Wu LLP. He advises clients on data security requirements under the law. Mr. Wu helps clients investigate and take action in response to security breaches, including appropriate notifications. He also analyzes liability arising from breaches and handles any resulting litigation. He counsels clients concerning cyber-risk insurance policies and coverage, and risk management strategies. In addition, he advises clients on secure electronic commerce using digital signatures, other secure electronic signatures, and encryption. Mr. Wu also advises clients concerning security and privacy policies and practices. Before beginning his practice at CKW, Mr. Wu was VeriSign, Inc.'s second in-house attorney, where he managed the development and deployment of worldwide policies and procedures for VeriSign's digital certification Internet security services. From 2001-2004, Mr. Wu was Co-Chair of the American Bar Association's Information Security Committee within the Section of Science and Technology Law.
